Dynamic Modders – Global Terms of Service & Master Agreement

Version 2.0 – Effective April 2026

1. Purpose, Mission & Educational Disclaimer

Dynamic Modders (the "Brand") operates dynamicmodders.com (the "Website") as a specialized platform for console modification preservation, hardware restoration, and educational research.

Educational Context: All products, guides, and files are provided for educational, research, and private-use purposes only. We specialize in the study of hypervisor exploits, unsigned code execution, and hardware longevity.

Service-Based Model: Payments made to Dynamic Modders are categorized as Service and Maintenance Fees. These fees cover the procurement of physical hardware (SSDs, USBs, Consoles), professional labor (cleaning, soldering, thermal application), high-speed cloud hosting, and platform maintenance.

No Piracy Support: We do not support, condone, or facilitate the illegal distribution of copyrighted software. Our services are strictly for the modification of hardware and software legally owned by the User.

2. User Responsibilities & Acceptable Use

By using our services, you agree that you will not:

Use provided modifications to gain an unfair advantage or "cheat" in competitive online multiplayer environments.

Redistribute, resell, or attempt to monetize any files, scripts, or custom dashboard themes created by Dynamic Modders.

Reverse engineer or claim authorship of proprietary Dynamic Modders recovery tools or scripts.

Abuse, harass, or threaten staff members during support sessions (Discord, Email, or Remote Screen-Share). Violations: Failure to comply results in a permanent global ban, loss of "Premium Support" status, and potential legal escalation.

3. Legal Ownership of Software (Global Requirement)

Dynamic Modders provides modification services, not software licenses.

Verification: By purchasing any modded content (Digital, ISO, or pre-loaded on hardware), you confirm you legally own the original retail copy of the game being modified.

Compliance: You are responsible for ensuring that your use of these modifications complies with the local laws of your jurisdiction.

4. Physical Hardware Terms (RGH Consoles & Bundles)

4.1 Refurbishment Standards

All consoles are professionally refurbished second-hand units.

Internal Quality: Every unit is stripped, deep-cleaned, and serviced with premium Arctic MX-4 thermal paste.

Cosmetic Condition: Minor surface marks, scuffs, or light scratches are consistent with refurbished hardware and do not constitute a "damaged" item.

4.2 The Recovery USB ("The Safety Net")

Every console bundle includes a proprietary USB Recovery Stick.

Ownership: This device is essential for the continued operation of the modded environment. It contains your unique NAND backup and a "Plugin Bypass" feature.

User Negligence: If the user formats, loses, or damages this USB, Dynamic Modders may be unable to provide software recovery support.

4.3 Processing & Lead Times

Due to the custom nature of these builds, a minimum of 2 working days is required for configuration, stress-testing, and software injection prior to dispatch.

5. Softmod Product Terms (Bad Avatar USB)

5.1 Non-Persistent Nature

The "Bad Avatar" exploit is a software-based, non-permanent mod. The console returns to its original retail state every time it is powered off.

5.2 User Requirements

It is the User's sole responsibility to ensure their console meets the following before purchase:

Dashboard Version: 2.0.17559.0.

Avatar Data: Official Avatar Update must be installed (no "Grey Mannequins").

Hardware: Not a "Winchester" motherboard (Late 2014-2015). Note: Dynamic Modders does not offer refunds if the User’s hardware is incompatible due to a failure to meet these requirements.

6. Digital Products & ISO Media

6.1 Strict No-Refund Policy

All digital products (Downloads, ISOs, Scripts, Binds, and Plugins) are strictly non-refundable once the access link has been generated or delivered.

6.2 Delivery of Digital Goods

Delivery is considered complete the moment the download link is provided. Compatibility with 3rd-party emulators or non-Dynamic Modders hardware is the User's responsibility.

6.3 ISO Discs

Modded ISO discs are intended for use with Flashed Disc Drives or the Hot-Swap method. We do not guarantee performance on un-modified or improperly flashed hardware.

7. Stealth Servers & Online Online Connectivity

7.1 3rd-Party Liability

Stealth Servers (XBGuard, Teapot, Cipher, etc.) are 3rd-party providers. Dynamic Modders is not liable for:

Server downtime or permanent outages of these providers.

Changes in the provider's subscription model or pricing.

7.2 Lifetime Licenses

"Lifetime" server access is defined as the lifetime of the server provider's operation. If a 3rd-party server ceases to exist, Dynamic Modders is not liable for the loss of service.

7.3 Risk of Bans

There is no such thing as a 100% un-bannable mod. You acknowledge that connecting a modded console to official servers carries a risk of account or hardware bans. Dynamic Modders is not liable for any enforcement actions taken by Microsoft or game publishers.

8. Warranty, Returns & Chargebacks

8.1 30-Day Hardware Warranty

We offer a 30-day limited warranty on console hardware failure.

Void Criteria: Warranty is void if: (A) The warranty seal is tampered with; (B) The console is opened; (C) The user attempts to flash the NAND or edit Dashlaunch settings incorrectly.

8.2 No Returns Policy

Due to the high cost of components, shipping, and the inclusion of digital assets, we do not accept returns for "change of mind."

8.3 Chargebacks

Any customer initiating a fraudulent chargeback (claiming non-delivery on a tracked/signed item or claiming "unauthorized purchase" after receiving digital links) will be permanently banned and added to a global vendor blacklist.

9. Support Services & Remote Access

9.1 Premium Support Role

Console and USB purchasers are granted a "Premium Support" role in our Discord.

9.2 Remote Screen-Share

By requesting a remote session, you grant Dynamic Modders permission to view and interact with your PC for troubleshooting. We are not liable for any data loss or privacy concerns arising during these sessions.

10. Respect for Creators & Copyright (Takedown Policy)

Dynamic Modders respects intellectual property.

We credit known creators of open-source tools where possible.

Takedown Requests: Valid requests for content removal by copyright holders should be sent to info@dynamicmodders.com including proof of ownership. We comply with the UK Copyright, Designs and Patents Act 1988.

11. Limitation of Liability

To the maximum extent permitted under UK law, Dynamic Modders is not liable for:

Console or account bans.

Hardware failure (RROD/E74) occurring after the 30-day warranty.

Data loss or NAND corruption caused by user modification.

Customs delays, import duties, or seizures for international orders. Our total liability will never exceed the amount paid for the specific product or service.

12. Delivery & Shipping

Every console is shipped via a tracked and signed courier.

Insurance: Transport insurance is included as standard.

Damage in Transit: Issues must be reported with photo/video evidence within 24 hours of delivery for insurance claims to be valid.

13. Governing Law

These Terms are governed by the laws of England & Wales. Disputes must be resolved through UK courts.

14. Final Acknowledgement

By completing a purchase, you confirm:

You understand the inherent risks of console modding.

You accept full responsibility for any bans or software errors caused by your use.

You acknowledge that all digital and custom-build hardware sales are final.
